I am a defendant in a criminal case. Can i be prosecuted for exercising my first amendment rights?

I sued someone in civil court, and they are now retaliating against me by having me prosecuted for suing them. The da even told me to my face no more lawsuits. I being charged with disorderly conducted because I was crying, and told someone how crappy I was feeling. I even called my doctor on that day, and shared the same feelings with them. I filed a motion to dismiss, based on violation of my first amendment right, and vindictive, and retaliatory prosecution as a affirmative defense. What are the chances of me getting the case tossed. I was never arrested, given a ticket, and the police never spoke with me.
